The Law and Your Rights

The United States Government adopted the National Labor Relations Act to give workers the federal right to organize, Section 7 of the National Labor Relations Act provides that "employees shall have the right to self-organize, to form, join, or assist labor organizations, to bargain collectively through representatives of their own choosing and to engage in other concerted activities for the purpose of collective bargaining or other mutual aid or protection."

Employees have the legal right to deal with their employer as a group, instead of individually. The Act guarantees employees the legal right to attend union meetings, to sign union cards, to pass out literature and talk to other co workers about joining the union. It also gives the employees the legal right to solicit union membership at work, in non work areas during non work time, ie: breaks, lunch, parking lots, etc.

The National Labor Relations Act also protects the employees who elect to exercise their rights under under law in forming a union. Section 8 of the Act makes it an Unfair Labor Practice for an employer to interfere with, restrain or coerce employees in the exercise of those rights as guaranteed them in Section 7 of the Act.

It is illegal for an employer to discriminate against an employee in regard to hire or tenure of employment, for their beliefs and activities in support of a union. It means that an employer cannot fire, threaten to take away benefits, or interfere with your right to organize.

The National Labor Relations Board is the Agency of the Federal Government that oversees that employees rights are not violated.
